Cape Coral, Florida
- HOA dues
- Set by unit type, see the fee table below
Figures come from association budgets and financials, dated in the copy below.
River Towers sits directly on the Caloosahatchee at 4260 and 4280 SE 20th Place, two buildings finished a year apart, 1973 and 1974, governed by a single condominium association. No master association, no sub-associations, just one entity for both buildings. I’m Brenton Miebach, a REALTOR® here in Cape Coral, and this is my working file on River Towers: what the recorded declaration actually says about the 55-and-older rule people quote you, what each unit type pays per the association’s approved 2025 budget, and where the fee figures floating around online stop matching the document. Every number below is dated to a named document, verify the current figure with the association, or by estoppel, before you write an offer.
Is River Towers a 55+ community?
Yes, as a matter of recorded fact, not marketing copy. The Amended and Restated Declaration of Condominium, recorded in 1998, states it twice: Article 9.2 requires at least one permanent occupant of each unit, and at least one record titleholder at the time of acquisition, to be 55 or older, consistent with the federal Housing for Older Persons Act. Exhibit “D,” §5.1 restates it in the rules themselves: “one resident must be 55 years or older.” I’ve now traced the complete recorded amendment chain to the Declaration, every instrument from the 1998 restatement through a February 2016 amendment (the most recent one on file), and none of them touch Article 9. That’s a documented restriction from the community’s own governing instrument, confirmed against the full public record, not an assumption about who lives there.
What are the HOA fees at River Towers?
One association, two unit types, two flat fees, not a share-based schedule.
| Unit type | Assessment | Source |
|---|---|---|
| 2-bedroom (100 of 108 units) | $603.00/month ($7,236/year) | River Towers Condominium Association’s approved 2025 budget |
| 3-bedroom (8 of 108 units) | $903.00/month ($10,836/year) | Same approved 2025 budget |
Both figures check out against real transactions, not just the budget page. A 2-bedroom unit that closed in December 2025 shows an HOA fee of $603 and a Total Annual Recurring Fees field of $7,236, exactly 12 × $603. A 3-bedroom unit that closed in November 2025 shows $903 and $10,836, exactly 12 × $903. When a monthly figure and an independently-entered annual figure reconcile that cleanly across separate transactions, it’s a strong sign the number is real, not a data-entry guess.
A correction while I’m here: you’ll also find $684 to $689 a month quoted for a 2-bedroom unit at River Towers. Each of those listings is internally consistent with its own annual total, but none of them match the 2025 approved budget’s flat $603 for every 2-bedroom unit, and the budget’s own math, 100 units × $603 × 12 months = $723,600, doesn’t leave room for a second 2-bedroom tier this year. My read is that $684–$689 was likely a prior year’s rate carried forward on a relisted unit, not a current second tier, but I haven’t confirmed that against a 2024 budget, so treat it as a caution about stale figures rather than a settled explanation.
One more thing worth flagging from the budget itself: reserve funding jumps to $167,500 for 2025, up from $0 booked in the 2024 actual column, plus a new $10,000 “milestone studies” line. That pairs naturally with the association’s 2024 structural reserve study, but the budget doesn’t say the two are connected in so many words, that link is my read of the document, not a stated fact, so ask the board for the study’s funded percentage directly rather than assuming.
What’s the minimum lease at River Towers?
Ninety consecutive days (or three calendar months, whichever is less), no more than one lease per 12-month period, and no more than two permanent occupants per bedroom, all from Declaration §10.1.1–10.1.2. One tenant in a leasing household must also be 55 or older, echoing the age restriction into the leasing context. On top of that, a recorded 2019 amendment (Lee County Official Records Instrument #2019000021379) bars any owner who acquires title after January 30, 2019 from leasing at all for the first 36 months of ownership, with exceptions for immediate-family transfers and estate planning. Board approval and a tenant interview are both required under §10.1.3; budget for an application fee at the time you lease, though I’d confirm the exact current amount with the association, the figures I’ve seen on listings aren’t yet backed by a published fee schedule I can point you to.
Does River Towers allow pets?
No, with narrow exceptions. Exhibit “D,” §5.2 of the recorded declaration allows only seeing-eye and hearing dogs, plus pets that were already “grandfathered” in before the rule took effect, and even those, the board may order removed if they become a nuisance. This is one of the more consistently enforced rules in the file; it matches what the great majority of recent listings report as well.
Is River Towers a smoke-free community?
Yes, and this is a fact I hadn’t seen published anywhere before pulling the recorded declaration directly. A membership-adopted amendment recorded February 23, 2016 (Instrument #2016000037468) added Article 9.9, “Smoking,” to the Declaration. It’s a total ban, not a common-areas-only rule: no smoking is allowed anywhere on the property, including inside individual units, on balconies or lanais, in parking lots, in recreational areas, or on the grounds. Electronic and vapor cigarettes are explicitly defined as smoking and are equally prohibited. The Board has the authority, but not the obligation, to designate an outdoor smoking area, and any such area would have to sit at least 100 feet from any building, dock, or recreational facility. If smoke-free matters to you, either as a buyer or as a landlord screening tenants, this is a recorded covenant, not a house rule the board could quietly relax.
What about the boat docks?
They’re association common elements, not a separate club, and the rules were completely rewritten by a Board-adopted amendment recorded September 3, 2025 (Instrument #2025000235671), it replaces the old 2008 rule word for word, so if you’ve seen a flat “32-foot maximum” quoted anywhere, that’s out of date. Maximum boat length is now canal-specific: 27 feet in the six center dock spaces on the Navajo Canal (33 feet at the two end spaces, where the boat may overhang the dock), and 38 feet on the Minstrel Canal. Dock usage is also formally tied to the community’s 55+ restriction: only recorded residents over 55 may use a dock, and guests can’t. No third-party marina corporation owns land here, the only non-unit parcel in the community belongs to the association itself.
Docks now come in two categories. Transient spaces are shared and limited to one month at a time, registered in advance with the Boat Dock Committee. Long-term spaces (three months or more) are assigned annually through a lottery: applications run January 1 through May 1 each year for an assignment beginning that October 1 and running through the following September 30. Owners must stay in good standing, fees current, no pending violations, to apply and to keep the assignment, boats must carry a current annual safety inspection and be used at least once a month on average, and no lifts of any kind, including floating docks, are permitted.
Did River Towers opt out of the fire sprinkler retrofit?
Yes. At a special membership meeting held March 21, 2016, the association voted to forgo the mandatory fire sprinkler (engineered life-safety system) retrofit under Florida Statute §718.112(2)(l), recorded as a Certificate of Vote to Forgo Retrofitting, Instrument #2016000082561. That means River Towers doesn’t carry the sprinkler-retrofit obligation some older Florida condos are now installing under. Worth asking the association directly whether that vote has been revisited since 2016, since opt-outs like this can be reconsidered by a later membership vote.
What are the parking rules at River Towers?
The vehicle and parking rules were fully rewritten by a Certificate of Amendment the membership adopted January 14, 2013 (Instrument #2013000106205), which amends both the Bylaws and the Rules and Regulations. The rewrite bans trucks, commercial or governmental vehicles, buses, open-bed vehicles, motor homes, RVs, and boats or trailers from being stored on the condominium property, and restricts motorcycles, scooters, and mopeds to designated parking areas. The same 2013 instrument also updated the board-election meeting notice procedure (Bylaws §§2.4 and 3.7), a governance detail, not something that affects a buyer, but recorded here since it’s part of the same instrument.

Thinking about River Towers?
River Towers is a straightforward file once you separate the recorded rules from the numbers people repeat online: one association, two buildings, two flat fees, and a genuinely age-restricted community under its own 1998 declaration. It sits in the same stretch of SE 20th Place as Parkside at the Rivers, and shares the peninsula with Clipper Bay a few blocks south. I track all three the same way, document by document. Tell me which unit type you’re considering and I’ll pull the current budget and any newer amendment before you write an offer. I’m Brenton Miebach, REALTOR®, and this stretch of the river is one I watch closely.
